Welcome to CEU Tracker Pro. These Terms of Service ("Terms") govern your access to and use of CEU Tracker Pro and the website at ceutracker.thecubbystop.com (collectively, the "Service"), operated by Gigglemite Designs, a division of Gigglemite LLC ("we," "us," or "our"). CEU Tracker Pro is a product of TheCubbyStop.

By purchasing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years of age to purchase and use CEU Tracker Pro. The Service is designed for working professionals managing continuing education requirements.

2. Description of Service

CEU Tracker Pro is a web-based continuing education tracking tool powered by Google Apps Script. It helps professionals track CEU/CLE/PDH credits, manage license renewals, handle reimbursements, set career goals, and generate audit-ready reports. The tool operates by reading from and writing to your personal Google account (Google Sheets, Google Drive, Google Docs, and Google Calendar).

3. Important Disclaimer — Not Professional or Legal Advice

CEU Tracker Pro is an organizational and record-keeping tool only. It is not a substitute for verifying your continuing education requirements directly with your state licensing board, professional association, or regulatory body.

While CEU Tracker Pro helps you track credits, deadlines, and category requirements, we do not guarantee:

• That the information you enter is accurate or complete
• That the tool's calculations (pace scores, projections, remaining credits) will match your board's official records
• That using the tool will ensure compliance with your licensing requirements
• That deadline reminders will be delivered on time or at all (email delivery depends on Google's services)
• That audit reports generated by the tool will satisfy your board's specific audit format requirements

You are solely responsible for verifying all credit requirements, deadlines, category rules, and renewal procedures with your licensing authority. CEU Tracker Pro is a convenience tool to help you stay organized — it does not replace your professional obligation to confirm compliance independently.

4. Google Account Requirement

Use of CEU Tracker Pro requires a Google account (personal or Workspace). By using the tool, you authorize the specific Google API permissions it requests. You are responsible for maintaining the security of your Google account. We are not liable for any unauthorized access to your data resulting from your account being compromised.

5. Data Ownership & Storage

You own your data. All data created through CEU Tracker Pro — including licenses, CEU logs, certificates, receipts, reports, goals, notes, and settings — is stored in your Google account. We do not store, access, or process your data on our servers. We have no claim to any data you create using the tool.

If CEU Tracker Pro were discontinued, all of your data would remain in your Google Drive and Google Sheets, fully accessible and editable by you.

6. Purchases & Pricing

CEU Tracker Pro is a paid product. Pricing is displayed on the sales page at the time of purchase. Payment is processed securely by LemonSqueezy. We do not store your payment information.

We reserve the right to change pricing at any time. Price changes do not affect existing purchases.

7. Refund Policy

We want you to be satisfied with CEU Tracker Pro. If you are not happy with your purchase, you may request a full refund within 14 days of your purchase date by submitting a request through our support page with your order number.

Refunds are processed through LemonSqueezy and returned to your original payment method. Please allow 5–10 business days for the refund to appear.

After 14 days, refunds are granted at our discretion on a case-by-case basis.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Redistribute, resell, or share your access to the tool with others
• Use automated means to access the Service without written consent

9. Intellectual Property

The Service, including all code, design, text, graphics, and branding, is owned by Gigglemite LLC and protected by intellectual property laws. "TheCubbyStop," "CEU Tracker Pro," "Pace Score," "Gigglemite Designs," and "Gigglemite" are trademarks of Gigglemite LLC. You may not use these marks without written permission.

10. Availability & Changes

We do not guarantee uninterrupted access. The Service depends on Google's infrastructure (Google Sheets, Drive, Apps Script), which may experience downtime or changes outside our control. We may modify, update, or discontinue features at any time. Because your data is stored in your Google account, discontinuation of the Service does not affect your data.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALCULATIONS, PROJECTIONS, OR REMINDERS WILL BE ACCURATE OR TIMELY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGGLEMITE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM MISSED DEADLINES, LAPSED LICENSES, INCORRECT CREDIT CALCULATIONS, FAILED EMAIL REMINDERS, OR RELIANCE ON THE TOOL FOR REGULATORY COMPLIANCE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT.

13. Indemnification

You agree to indemnify and hold harmless Gigglemite LLC, its officers, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your failure to independently verify compliance with your licensing requirements.

14. Third-Party Services

CEU Tracker Pro interacts with Google services (Sheets, Drive, Docs, Calendar, Gmail) and payments are processed by LemonSqueezy. We are not responsible for the availability, performance, or practices of these third-party services. Changes to Google's APIs or services may affect the functionality of CEU Tracker Pro.

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your data remains in your Google account and is unaffected. You may stop using the Service at any time.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the State of California.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gigglemite LLC regarding your use of CEU Tracker Pro.
